Brooklyn Renters: How to Get Your Full Security Deposit Back

Moving out of your Brooklyn apartment soon? Don’t let your hard-earned money slip away. One of the most common rental disputes in NYC—according to The Wall Street Journal, The New York Times, and The Real Deal—is over security deposit returns.

Whether you’re relocating across the city or leaving Brooklyn behind, this guide will walk you through everything you need to know to get your full deposit back—legally, quickly, and stress-free.

Why Do Landlords Withhold Security Deposits?

In New York City, landlords are legally allowed to deduct from your deposit for:

  • Unpaid Rent – Make sure your last payment clears.

  • Damages Beyond Normal Wear & Tear – Think broken fixtures, holes in the wall, or major stains.

  • Cleaning Costs – A dirty apartment could cost you.

  • Missing Keys/Fobs/Remotes – Replacements come out of your deposit.

 The Ultimate Move-Out Checklist

Before turning in your keys, follow this step-by-step checklist to secure your full deposit:

  1. Review Your Lease
Look for move-out notice periods, repair clauses, and cleaning requirements.

  2. Request a Pre-Move-Out Inspection
This gives you time to fix issues before deductions are made.

  3. Patch & Repair
Fill nail holes, touch up paint, and replace any damaged items.

  4. Deep Clean the Apartment
Scrub appliances, mop floors, and clean bathrooms—leave it spotless.

  5. Take Photos & Video Documentation
Capture every room before you go to prove the condition.

  6. Return All Keys, Fobs & Remotes
Avoid automatic deductions by handing in every access item.

  7. Provide a Forwarding Address
Ensure your landlord knows where to send your check.

What If Your Deposit Is Unfairly Withheld?

If you didn’t receive the full amount back:

  • Request a Detailed Itemized Deduction Statement

  • Submit Your Photos as Evidence

  • Send a Formal Written Request via email or certified mail

  • File a Complaint with NYC’s Tenant Rights Board or in Small Claims Court

🗓️ NYC landlords are required to return your deposit within 14 to 30 days of move-out.
